  • For the client with a straight forward estate with cash, bank accounts, insurance policies and liquid assets. Generally this can include a property and business assets as an outright gift, however, there is no facility for more complex protection, e.g. children’s trusts, discretionary trust, lifetime interest, gift of separate shares etc.
  • This service provides the facility to appoint executors, guardians, distribute personal gifts, cash gifts and residue. Can also express funeral wishes.
  • Allows for any specific distribution of a business asset or share of to a named beneficiary 
  • Many parents feel that the legal age of inheritance for children (currently 18) is too low and that the release of funds to a child at this age may not be beneficial.
  • A children’s trust allows for an older age to be chosen, (e.g. 21/23/25) and gives the executors/trustees direction on the early release of money via an Expression of wishes letter. (Typically the letter gives direction to release money for University fees, regular income, medical fees, purchase of first property, car, and holidays etc).
  • Allows a % of the residue, a cash amount or a specific asset, (e.g. insurance policy) to be set aside for the sole benefit of an individual who cannot manage their own finances(Person may be mentally or physically incapacitated or alcoholic, bankrupt etc). The executors/trustees would provide the beneficiary with funds as required. The trust would normally last for a maximum of 80 years with any remaining amount left to the residue or another beneficiary. 
  • At its simplest, planning your estate consists of making a Will. Willcraft services will assist you and our wide range of legal services and years of experience will ensure your estate will be secure.
  • Willcraft will act as co-executor of a will for every client in order to provide the professional back up and support that a family member or nominated executor may need. Willcraft would only act if called upon and any work would be quoted for ‘prior’ to commencement. Willcraft can also provide full executor services if required. 
  • Provides protection for the client in the event of an inability to operate their affairs due to physical or mental incapacity (e.g. prolonged hospital stay or mental illness). The nominated attorney, usually the executor(s), will be able to step in and manage the day to day finances.
  • Additional fees are applicable for this service.
  • Keeping a will up to date is vital! Things change for most families, and this service provides the additional benefits of being able to update the Will at ANYTIME in the future at no extra cost. In addition the executors of the Will can receive FREE advice and assistance in the execution of the Will.
  • The ability to be in control of medical and health circumstances in the future is important to many people. This service allows clients to give advance direction on what should happen when their future health deteriorates. 
  • An amount of money may be set aside for the sole benefit of a surviving pet for care, vet fees etc. The executor/trustee would ensure the trust was spent for the sole benefit of the named pet. On the death of the pet any amount left in the trust would be distributed as per the residue or to a named beneficiary. 
  • Allows a property, or part ownership of a property, to be gifted to a specific named beneficiary. Client may also allow a person to have use of the property (or part of) but not the ownership for a specified time (e.g. 10 years, until death etc.) before it passes to the eventual beneficiary. (Lifetime interest)
  • 1) This trust offers protection against a share of a property being used to pay for future care home fees
  • 2) This trust also offers protection against a share of property being given away by a surviving joint owner, e.g. remarriage etc.
  • 3) Most properties in the UK owned by 2 people are held as Joint Tenants, use of the Protective Property Trust would involve changing the ownership to Tenants in Common, which is completed by Willcraft. (Fee applicable)
  • A storage service is provided with every product to ensure that documents are kept safely for the client and for the eventual use that they are intended.
  • N.B. A small annual fee is applicable with this service.
  • Storage is a ‘default’ service offered to all clients unless they already have a secure storage facility at home or existing arrangement with a bank or similar institution.
  • This service is generally for clients with more complex circumstances including property, business and children or step children. This service provides the added benefit of being able to add Trusts (Discretionary, Children’s, Pet, Protective Property Trust and Lifetime Interest)
